Terms of Service

These Terms of Service ("Terms") govern your use of Pocket Money Advisor ("the Service"), provided by [Legal entity name, pending UG/GmbH formation]. By creating an account, you agree to these Terms.

1. The Service

Pocket Money Advisor is a personal finance tool that helps you understand your spending, set budgets, and discover savings opportunities. During the beta period, the Service is provided free of charge.

The Service is currently available by invite only during the closed beta phase.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a contract under German law. The Service is intended for users resident in Germany or other EU member states.

3. Your Account

• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate information and keep it up to date.
• You may not share your account with others or use the account of another person.
• Notify us immediately at hello@pocketmoneyadvisor.com if you suspect unauthorised access.

4. CSV Data Import

The Service allows you to upload CSV exports from your bank to analyse your transactions. By uploading a CSV file:

• You confirm that you have the right to upload and process this data (it is your own financial data).
• You understand that transaction data is stored on our servers to provide the Service.
• You understand that we do not connect directly to your bank and do not store bank credentials.
• You can delete your imported data at any time via the Accounts page or by deleting your account.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable law.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
• Upload malicious files, scripts, or content that could harm the Service or other users.
• Use automated tools (bots, scrapers) to access the Service.
• Attempt to gain unauthorised access to other users' accounts or data.

6. Financial Information Disclaimer

The Service provides financial information and tools for personal organisation purposes only. Nothing in the Service constitutes financial advice, investment advice, tax advice, or legal advice.

Savings estimates, spending projections, and alternative product suggestions are informational only. You should consult a qualified financial advisor before making financial decisions.

We make no guarantee that the spending analysis, categorisation, or projections are accurate or complete.

7. Beta Service Notice

The Service is currently in closed beta. During this period:

• Features may change, be added, or be removed without notice.
• The Service may be interrupted for maintenance or improvements.
• We may terminate beta access at any time.
• Data from the beta period may or may not be migrated to the production version.

8. Intellectual Property

All software, designs, and content within the Service are owned by or licensed to us. You retain ownership of your personal data. You grant us a limited licence to process your data solely to provide the Service.

9. Limitation of Liability

To the maximum extent permitted by German law, we are not liable for indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our liability for direct damages is limited to the amount paid by you in the 12 months preceding the claim (which may be zero during the free beta).

This limitation does not apply to damages caused by gross negligence or intentional misconduct, nor to claims under mandatory German consumer protection law (§§ 305 et seq. BGB).

10. Termination

You may close your account at any time via Settings → Danger Zone → Delete Account. We may suspend or terminate your account for breach of these Terms, with reasonable notice where possible.

11. Changes to These Terms

We may update these Terms. We will notify you via email at least 30 days before material changes take effect. Continued use after the effective date constitutes acceptance of the new Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany. The exclusive place of jurisdiction for disputes with non-consumer users is Frankfurt am Main. Mandatory consumer protection provisions of your country of residence remain unaffected.
